The revelation that menstruation tracking apps share sensitive data with third parties, like Facebook, provoked a sense of violation among users. This case highlights the need to address ethics and governance of health data created outside of traditional healthcare contexts. Commodifying health data breaches trust and entails health and moral risks. Through the metaphor of The Wizard of Oz, we argue that these apps approximate healthcare without the professional competency, fiduciary duties, legal protections and liabilities such care requires and thus (...) represent an innovation in the annals of snake-oil salesmanship and the systematic devaluing of women’s bodies, lives, and work. This review seeks to present a comprehensive picture of recent discussions in the social sciences of the anticipated impact of AI on the world of work. Issues covered include: technological unemployment, algorithmic management, platform work and the politics of AI work. The review identifies the major disciplinary and methodological perspectives on AI’s impact on work, and the obstacles they face in making predictions. A significant theory of corporate social responsibility is the Stakeholder Model. Within this model, entities make decisions that impact all stakeholders. Occasionally, the decision that is made ultimately impacts one stakeholder differently than another. Negative data by its very definition is seen as problematic for any organization as it pertains to its stakeholders. When confronted with the data or the potential of the data being negative to desired outcomes or directions of programs, an organization’s leadership may be faced with an (...) ethical conundrum. In trying to connect a primarily literary account of sentimental history and theory to a primarily philosophical account of feminist pragmatism,1 certain dangers emerge. One is to unintentionally privilege the genre of philosophy over the genres of poetry or sentimental fiction. In H.S. Thayer’s insightful Meaning and Action: A Critical History of Pragmatism, as but one example, philosophical writing subordinates other genres, such as poetry or novels, leading to readings of Dewey and James that disproportionately weight the influence of philosophical (...) writing on their attitudes. While debate continues over the role of the lawyer in society, this article notes that the recently amended professional conduct rules of both barristers and solicitors and the proposed draft National Law prioritise the duty to the court and the administration of justice. In addition, the Australian Learning and Teaching Council's threshold learning outcomes for legal education corroborate these obligations when they assert that the role of a lawyer includes a professional responsibility to promote justice in service to the community. By referring to Australia's proposed regulatory framework and associated national professional conduct rules, and drawing upon the American Bar Association's Model Rules of Professional Conduct and a body of US literature that refers to lawyers as public citizens, this article will argue that Australian lawyers owe a duty to the public in their everyday dealings with clients. In this article, I examine and criticize John Searle's account of the relation between mind and body. Searle rejects dualism and argues that the traditional mind-body problem has a 'simple solution': mental phenomena are both caused by biological processes in the brain and are themselves features of the brain. More precisely, mental states and events are macro-properties of neurons in much the same way that solidity and liquidity are macro-properties of molecules. However, Searle also maintains that the mental is 'ontologically (...) irreducible' to the physical, a view which follows from his understanding of the status and nature of consciousness. Consciousness is essential to the mind; subjectivity is essential to consciousness; and no purely objective, physical description of consciousness could ever capture or explain its essentially subjective character. None the less, Searle maintains that irreducibility is a 'trivial' result of our 'definitional practices' and is entirely compatible with his theory. I contend that this latter claim is based on an equivocation: Searle's conclusion only seems to follow because he alters and trivializes what philosophers ordinarily mean by 'reduction'. I also maintain that Searle's position is reductionist in the ordinary, nontrivial sense. For this reason, his theory fails to accommodate the subjective character of consciousness and fails to solve the traditional mind-body problem. Finally, I briefly discuss Searle's claim that he is not an epiphenomenalist, and argue that given the assumptions of his view there is no interesting causal role for consciousness in the physical world. My purpose here is to undercut rorty's critique of "the privacy objection" to the mind-body identity theory. central to his critique is his argument that in the case of introspective reports, we need to and can distinguish misnaming from misjudging only if we have "public" criteria for the proper use of introspective vocabulary. i grant rorty this much, but argue that this concession does "not" pose a problem for "the privacy objection." he supposes otherwise, i argue, because he "inflates" the (...) character of the public criteria we have/need in order to operate within such introspective contexts. The concept of equity is clearly important in Thomas Hobbes's philosophy. In his writings he repeatedly employs it in significant load bearing ways, particularly in the areas of civil law and governance. Equity is, however, not directly addressed in a sustained way in his core works and—perhaps even more frustratingly—it is often applied in ways which ask more questions about the concept than they answer. This presents an impediment to accurately understanding what equity really means to Hobbes. His late Dialogue (...) Between a Philosopher and a Student of the Common Laws of England (1681) seems to offer a solution to this challenge. This work contains extensive discussion on equity, including on the application of equity in relationship to absolute rule. However, equity in the Dialogue is not always the same as what we see in Hobbes's core works. The question is, did Hobbes change his mind on equity? This article argues no. Hobbes did not change his mind on equity; rather, within the Dialogue he is engaging with a common understanding of the term as it existed in English law. Consequently, Hobbes's discussions here should not inform us about how equity fits into his philosophy. (shrink)

Corbin begins with a kind of spiritual topography of the twelfth century, emphasizing the differences between exoteric and esoteric forms of Islam. He also relates Islamic mysticism to mystical thought in the West. The remainder of the book is devoted to two complementary essays: on "Sympathy and Theosophy" and "Creative Imagination and Creative Prayer." A section of notes and appendices includes original translations of numerous Su fi treatises. Harold Bloom's preface links Sufi mysticism with Shakespeare's visionary dramas and high tragedies, such as The Tempest and Hamlet . These works, he writes, intermix the empirical world with a transcendent element. ABSTRACTA lawyer's behaviour derives from their own principles and values, the norms of professionalism, the professional conduct rules and the common law. In the past, much emphasis has been placed upon the first two sources as they formed the basis of self-regulation and influenced the development of legal ethics. Recently, the Australian codes of ethics explicitly detail an increasing range of duties which might reasonably have been thought to be implicit characteristics of sound ethical values and professionalism, for example, a (...) duty to be civil, and an explicit prohibition against harassment, intimidation and bullying. Such additions have been deemed necessary as a response to increasing concerns about lawyer incivility and empirical reports detailing high levels of harassment, intimidation and bullying within law firms. Phenomenologists such as Merleau?Ponty have argued that the ordinary teleological relation between an embodied agent and the world is neither ?subjective? nor ?cognitive?, i.e. that it is not normally mediated by a chain of explicit cognition occurring within a distinct mental subject. Yet, while this seems true from a first?person, phenomenological perspective, I argue that teleological forms of explanation require the ascription of Intentional states. Intentional states, however, are usually regarded as subjective, cognitive states. In order to reconcile the phenomenology (...) with the logic of teleology, I introduce the notion of ?body?intentionality?. I maintain that we can use a modified version of Jonathan Bennett's concept of a teleological law to specify third?person empirical criteria for a pre?cognitive, pre?subjective kind of Intentionality. I also argue that this notion of body?intentionality provides us with at least a partial solution to the mind?body problem that avoids the inadequacies of the computational theory of mind. (shrink)

This case study attempts to frame the ethical considerations between hiring a known smoker over a non-smoker in today’s cultural climate. Referenced data from a parallel project gauging the likelihood of Human Resources representatives to hire smokers and accommodate them in the workforce could help manage the response and critical thinking components of the case scenario. Questions also arise as to whether it is advisable for employers to take particular attitudes toward smoking in the workplace. This is not only in (...) the interest of the health of employees, customers and clients, but is also on the basis of a concern that employers may otherwise expose themselves to lawsuits where employees may, on the basis of illness contracted due to a smoking environment supported by an employer, sue for the costs of care and income. Often conflicts arises between stakeholders of a firm. Instances where one stakeholder’s needs conflict with the rights of other stakeholders can put managers in a precarious situation. Strict adherence to contract rules, for example, may be the absolute right of the firm but at the same time enforcement of that contractual right or rule may be unduly damaging to another stakeholder. Managers in these situations may seek to find a balancing act between the two conflicting sides in order to maintain (...) the balance that prioritizes the competing and conflicting responsibilities. However, the notion of ‘civility’ is itself, often contentious, and the line between ‘robust' communication and incivility is unclear.Does (...) civility matter? Over recent years, lawyer misconduct and regulation of the profession have been topics of considerable interest. Yet, when the topic of legal ethics is raised, the focus tends to be on lawyer conduct external to the firm: lawyer conduct in court; lawyer conduct vis-a-vis client; or lawyer conduct vis-a-vis opposing counsel or the judiciary. The recent National Attrition and Re-engagement Study, however, raises a different aspect of legal professional ethics. This Report found a widespread incidence of bullying, intimidation, discrimination and (...) harassment within law firms, primarily affecting though not confined to, female lawyers. Of course, bullying and associated behaviours are not confined to the legal profession. But these behaviours are at odds with a profession that purports to be deeply concerned with the ethical conduct of its members. Arguing that ‘ethics begins at home’, this paper suggests NARS raises uncomfortable questions about legal professional ethics: if law firms cannot treat their own staff members ethically, what does that say about the firm’s approach to ethical conduct more generally? And if this culture is as widespread as the report suggests, what does this say about the ethics of the legal profession as a whole? (shrink)

This article addresses a common yet rarely discussed aspect of hospital care—a pro-active approach to ethical dilemmas. Potential ethical conflicts often present warning signs to clinicians, analogous to the warning lights on a car’s dashboard. Using a recent case study, a commonly encountered clinical decision—a conflict about whether to terminally extubate a critically ill patient versus whether to offer a tracheostomy— we describe a pro-active approach to ethical conflicts and outline three learning objectives: (1) the need for a robust understanding (...) of the term “futility,” (2) the need for an appreciation of the various and often conflicting interpretations of “improved/improving,” and (3) the need to understand the challenges of surrogate decision making. This is the first complete English translation of the Jami al-hikmatayn, written in Persian, the final, and crowning, work of the great poet, philosopher, and Ismaili missionary Nasir-i Khusraw (1004-1077). Twin Wisdoms Reconciled was written at the request of the emir of Badakhshan 'Abu al-Ma'ali 'Ali ibn Asad' who was perplexed by the questions in a long philosophical ode written a century earlier by Abu al-Haytham Jurjani, an obscure Ismaili author. The ode consists of a series of some 90 questions (...) on a wide range of subjects, from logic and metaphysics to medicine, cosmology, and physics, as well as esoteric Ismaili doctrine. Nasir-i Khusraw's text takes the form of a commentary on certain astutely selected lines. Twin Wisdoms Reconciled represents yet another example of the author's lifelong endeavour to transform Persian philosophical prose into a deft and nuanced instrument of expression. The work has not been as extensively studied as Nasir-i Khusraw's other major theological and philosophical treatises, all written in his final exile in Badakhshan, in part perhaps because of its textual difficulties. Twin Wisdoms Reconciled survives in a single manuscript of dubious accuracy in the Aya Sofya collection, Suleymaniyye Library, Istanbul. The present translation is based on the critical edition of the text produced by Henry Corbin and Mohammed Mo'in in 1953, but with frequent reference to the unique original manuscript. Twin Wisdoms Reconciled represents an endeavour to reconcile two apparently opposed forms of knowledge: the knowledge accorded by revelation and exegesis and the knowledge gained by reason. Seeing that "the bazaar of wisdom" stands empty because of the mutual incomprehension of traditional theologians and Aristotelian philosophers, Nasir-i Khusraw stepped boldly forward to reinvigorate that desolate marketplace. His final work, written in 1070, is thus a testimony as well as an exposition of his mature thought. (shrink)

This paper reviews briefly the reception of the Arabic philosophy in the Latin West and it analyzes the work of Henri Corbin entitled Histoire de la philosophie islamique, in which the author identifies the philosophy realized in the Arab world with the Islamic religion, offering a very personal and particular vision of that philosophy.

This paper analyses the concept of the Imagination of Henry Corbin (1903–1978) in relation to Daisetsu T. Suzuki (1870–1966). Besides being a renowned orientalist and scholar of Islamic thought, Corbin was a philosopher par excellence whose original thought deserves to be studied. So, I present this paper as a contribution to the evaluation of Corbin as a philosopher. In doing so, I shall shed light upon the philosophical affinity between Corbin and Suzuki, which has thus far (...) rarely been discussed in depth. Their ideas, in fact, resonate with each other—or Corbin is sympathetic to Suzuki—at a deep level, especially on the argument of Imagination, through Suwedenborgian thought, into whom both channel their interests. An exploration of this relationship of influence with Suzuki shall make a great contribution to a better understanding of Corbin’s own concept of Imagination, which could shake up our taken-for-granted idea of “imagination.”. By the end of World War II, religion appeared to be on the decline throughout the United States and Europe. Recent world events had cast doubt on the relevance of religious belief, and modernizing trends made religious rituals look out of place. It was in this atmosphere that the careers of Scholem, Eliade, and Corbin--the twentieth century's legendary scholars in the respective fields of Judaism, History of Religions, and Islam--converged and ultimately revolutionized how people thought about religion. Between 1949 (...) and 1978, all three lectured to Carl Jung's famous Eranos circle in Ascona, Switzerland, where each in his own way came to identify the symbolism of mystical experience as a central element of his monotheistic tradition. In this, the first book ever to compare the paths taken by these thinkers, Steven Wasserstrom explores how they overturned traditional approaches to studying religion by de-emphasizing law, ritual, and social history and by extolling the role of myth and mysticism. The most controversial aspect of their theory of religion, Wasserstrom argues, is that it minimized the binding character of moral law associated with monotheism.The author focuses on the lectures delivered by Scholem, Eliade, and Corbin to the Eranos participants, but also shows how these scholars generated broader interest in their ideas through radio talks, poetry, novels, short stories, autobiographies, and interviews. He analyzes their conception of religion from a broadly integrated, comparative perspective, sets their distinctive thinking into historical and intellectual context, and interprets the striking success of their approaches. Scheler’s impact on Non-conformism points to an affinity between the phenomenology of affectivity and the antibourgeois movement in interwar France. Scheler himself calls on the vitalism of Guyau and Bergson to argue against projective concepts of empathy. He broadens affective situations into an interaction between bourgeois tendencies to narrow ressentiment and generous cultural dynamics. Non-conformists appropriate these modes of affectivity, pried from faith contexts. Jankélévitch transforms Scheler’s value ethic into an aggressive virtue ethic. Corbin draws from Scheler the inspiration (...) for a syncretistic anthropology of responsiveness. With reference to Scheler, Aron develops an ethic of value decisions that is free from ressentiment. This paper draws on a study of numeracy coordinators in primary schools in the UK in the second year of the implementation of the National Numeracy Strategy (NNS). It identifies them as working between three main tasks: embedding the Strategy, sustaining teacher collegiality and auditing accountability. We identify tensions in 'being a coordinator' in relation to these tasks, especially for discourse and identity. We assess the usefulness of the metaphor of 'brokering' in 'communities of practice' (Wenger, 1998) to theorise such (...) tensions. We conclude with some reservations about the metaphor, especially in the way the tensions are discursively performed in relation to the rate of change, complexity of notions of professional identity, and the problematic 'community' status of audit in the educational context. This paper proposes a Cournot game organized by three competing firms adopting bounded rationality. According to the marginal profit in the past time step, each firm tries to update its production using local knowledge. In this game, a firm’s preference is represented by a utility function that is derived from a constant elasticity of substitution production function. The game is modeled by a 3-dimensional discrete dynamical system. The equilibria of the system are numerically studied to detect their complex characteristics due (...) to difficulty to get an explicit form for those equilibria. For the proposed utility function, some cases with different value parameters are considered. Numerical simulations are used to provide an experimental evidence for the complex behavior of the evolution of the system. The obtained results show that the system loses its stability due to different types of bifurcations. (shrink)
